These Terms govern your use of the Mr Miles apps for Android (Google Play) and iOS (Apple App Store) and the website mrmiles.app. Privacy details are in the Privacy Policy. By downloading, installing, or using the app, or by accepting these Terms in-app, you agree to them. If you do not agree, do not use the app.

The service

Mr Miles is a mileage / Fahrtenbuch logbook helper for Android and iOS (soft launch: United States, Germany, Switzerland). Your logbook is stored on your device. There is no Mr Miles account, and there are no Mr Miles servers holding your logbook.

  • Android: the app disables Android Auto Backup for itself (android:allowBackup=false), so Google’s usual phone backup does not copy your logbook into your Google account backup.
  • iOS: the logbook is left out of iCloud and computer backups unless you turn on the in-app “iCloud backup” switch (off by default); app settings are always in your iPhone backup. Neither is a Mr Miles cloud.

Features include:

  • GPS trip detection (including in the background, as the OS allows)
  • Manual trips
  • Classifications and rate helpers
  • Vehicles
  • Exports
  • Free tier and Pro via Google Play Billing (Android) and/or Apple In-App Purchase (StoreKit) (iOS), depending on platform
  • Optional Local-only mode (on Android: no Google map tiles or Google geocoding; on iOS: no Apple map tiles or Apple address lookup; routes are drawn from recorded points)
  • Firebase Analytics and Firebase Crashlytics (Android and iOS), only if you turn telemetry on; off by default; you can change this in Settings (never trips, places, or addresses)
  • No AdMob; no Firebase backup cloud

Third parties (Google Maps, Google Play Billing / Apple StoreKit, Firebase if telemetry is on, and any backup destination you pick) may receive limited data as described in the Privacy Policy. Do not assume that nothing ever leaves the device when Maps or other integrations are used.

Age

Mr Miles is intended for users 18 years or older. You must be at least 18 to use the app.

Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Mr Miles, obtained via Google Play or the Apple App Store, on devices you own or control, for lawful logbook purposes.

Do not: reverse engineer the app except where mandatory law allows; circumvent free-tier or Pro limits; use the app for unlawful purposes; or present reports as certified by Mr Miles or any tax authority.

Not tax, financial, or legal advice

Mr Miles is a software tool only. It is not a tax advisor, accountant, or lawyer. Rate tables, classifications, and exports are helpers for your own records. Whether a tax authority, employer, or court accepts your documentation is solely your risk. You remain responsible for accuracy and filings. Consult a qualified professional if you need advice.

Driving safety

Do not use interactive features of Mr Miles while driving. Set up, review, and edit only when it is safe and legal to do so. Automatic detection is an aid, not a substitute for attentive driving. You assume the risk arising from in-vehicle use.

Free tier and Pro (App Store / Google Play)

Paid Pro features are sold through the platform store where you installed Mr Miles:

  • Android: Google Play Billing
  • iOS: Apple In-App Purchase (StoreKit)

Purchases, taxes shown in the store, renewals, cancellations, and refunds follow Apple’s or Google’s terms and policies (as applicable). For billing or refund questions, use that store’s support channels.

Uninstalling Mr Miles does not cancel a Pro subscription. Manage, change, or cancel subscriptions in your Apple ID / App Store subscription settings or Google Play subscriptions, as applicable.

Beyond what Apple/Google policy or mandatory law requires, Pro fees are non-refundable. Mandatory consumer withdrawal (cooling-off) rights, where they apply to digital services, are not excluded; early performance may affect withdrawal only where you have expressly requested it and mandatory law allows.

If you subscribe on iOS, Apple’s App Store subscription disclosures (title, length, price, and cancellation path) also apply as shown at purchase.

Apple Licensed Application (iOS)

If you obtain Mr Miles from the Apple App Store, the following also applies, to the extent required by Apple:

  • These Terms are between you and Gira Mobile (Andrea Girardello) only, not with Apple. Gira Mobile — not Apple — is solely responsible for the Licensed Application and its content.
  • The licence granted to you is limited to a non-transferable licence to use Mr Miles on Apple-branded products that you own or control, and as permitted by the App Store Terms of Use (including Family Sharing / volume purchasing where applicable).
  • Apple has no obligation to provide maintenance or support for Mr Miles. To the maximum extent permitted by applicable law, Apple has no warranty obligation for Mr Miles; any claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Gira Mobile’s sole responsibility (subject to the AS IS and Liability sections below). Product claims (including product liability, failure to conform to legal or regulatory requirements, and consumer-protection or similar claims) are addressed to Gira Mobile, not Apple, to the extent permitted by law.
  • In the event of any third-party claim that Mr Miles or your possession and use of it infringes a third party’s intellectual property rights, Gira Mobile — not Apple — will be solely responsible for the investigation, defence, settlement, and discharge of that claim, to the extent required.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms as they relate to your licence of Mr Miles. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Nothing in this section expands Apple’s obligations beyond the App Store rules, or reduces mandatory consumer rights that cannot be waived.

Maps

If Local-only mode is off, map display and address lookup use Google Maps on Android and Apple MapKit / Apple geocoding on iOS. Android use of Google Maps is also subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy, incorporated by reference.

No warranty (AS IS)

To the maximum extent permitted by mandatory law, Mr Miles is provided AS IS and AS AVAILABLE, without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy of distances or rates, uninterrupted GPS, acceptance of reports by any authority, or non-infringement. We do not warrant that automatic detection captures every journey. Mandatory consumer protections that cannot be waived remain unaffected.

Liability

Nothing in these Terms excludes liability that cannot be excluded under mandatory law, including under Swiss law liability for intent (Absicht) and gross negligence (grobe Fahrlässigkeit) (principles reflected in Art. 100 OR), personal injury where exclusion is restricted, and equivalent mandatory EU/EEA consumer protections.

Subject to that carve-out, our aggregate liability relating to Mr Miles or these Terms is limited to the amount you paid for Pro in the twelve (12) months before the claim, or CHF 0 if you use only the free tier, where such a cap is enforceable.

Subject to the same carve-out, we are not liable for indirect, incidental, special, consequential, or punitive damages; lost profits; lost data (including logbook loss if your device fails and you have no backup); tax assessments; penalties; or employer disputes.

Non-acceptance of Mr Miles reports by any tax authority or third party is your sole risk, to the extent permitted by mandatory law.

Intellectual property

Mr Miles, its name, logos, and UI remain owned by Gira Mobile (Andrea Girardello) or its licensors. Open-source components: see Licenses. These Terms do not transfer ownership of the app to you.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted at https://mrmiles.app/terms with a new “Last updated” date.

You are responsible for checking this page regularly. For material changes, we may (but are not obliged to) also mention them in an app update or an in-app notice. We do not require you to re-confirm or re-accept these Terms in the app when they change (including after your initial in-app acceptance).

If you continue to use Mr Miles after updated Terms are posted, you accept the updated Terms, to the extent permitted by applicable law. If you do not agree, stop using the app and uninstall it (uninstalling does not by itself cancel an App Store or Google Play subscription — manage that in the relevant store).

Suspension and termination

You may uninstall the app at any time. Uninstalling does not by itself end an App Store or Google Play subscription; manage that in the relevant store. We may suspend or end access for material breach, store or legal requirements, or product discontinuation (with reasonable notice where practicable). The advice disclaimer, no-warranty, liability, governing-law, and similar provisions survive termination.

Governing law and courts

These Terms are governed by the laws of the Canton of Zürich, Switzerland (excluding conflict-of-law rules). Exclusive venue: the courts of Zürich, Switzerland, subject to mandatory consumer forum rights (including home-court rights for consumers in the EEA or elsewhere that cannot be waived).

Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and us regarding Mr Miles. If a provision is invalid, the rest remains in force. Not enforcing a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor of the publishing activity. The English version controls. Apple’s and Google’s rules govern billing and refunds as between you and that store. Gira Mobile also publishes general terms at gira.me/terms; for Mr Miles, these Terms prevail.
